Introduction
FIDIC: A Focus on Claims
It has been over a decade since FIDIC introduced its first edition construction and engineering contract. In this time we have seen arbitrations, adjudications, court cases and a multitude of claims being made by both contractors and employers.
In this one day workshop we focus on claims under the FIDIC contracts: when they can be brought, how they must be brought, how they are assessed, and how they are resolved.
In particular, this course will address:
- how FIDIC addresses Contractor’s claims;
- the evaluation of extensions of time;
- concurrent delays
- general delay and disruption claims
- the Employer’s claims clause;
- dealing with the programme including shortfalls in the programming clause the role of the Engineer in determining claims.

- An understanding of the process for making claims
- An understanding of the key clauses which allow the contractor to claim
- An understanding of when the contractor can claim time; Time and Cost and reasonable profit
- An understanding of the use of the programme in evaluating claims;
- An understanding of how monetary claims are valued;
- An understanding of concurrent delays, and delay and disruption clauses; and
- An understanding of the role of the Engineer in determining claims;
- An understanding of the process to be followed by Employers who wish to claim.

- an awareness of some pitfalls when working with the FIDIC contracts;
- an awareness of projects where the FIDIC contracts have been used; and
- insight into how the FIDIC contracts work in practice, on both big and small projects.
